New Rights, New Responsibilities, New House Rules


New laws around private renting started rolling out in Scotland from 1st December 2017.  If you rent privately, it’s important that you make sure you are switched on to how these changes will affect you.


Improvements for tenants include:

• more security – it’s an open-ended tenancy so your landlord can’t just ask you to leave because you’ve been in the property for a set length of time

• protection from frequent rent increases – your rent can’t go up more than once a year and you must get at least three months’ notice of any increase

• rent increases can be referred to a rent officer, who can decide if they’re fair

• if you’ve lived in a property for more than six months, landlords have to give 84 days’ notice to leave (unless it’s because you’ve done something wrong)

• if you think you were misled into moving out, you can now apply to the First-tier Tribunal for a ‘wrongful termination order’. If the Tribunal gives the order it can award up to six months’ rent in compensation

• local authorities can apply to Scottish Ministers to cap levels of rent increases for tenants with a PRT in areas where rents are rising too much

•Private Rented Sector  for Landlords  is an online resource which consists of 3 modules  to help landlords navigate the maze of information on private tenancies.

•Private Residential Tenancy for housing support practitioners will provide practitioners  with knowledge about  this tenancy which will help when supporting client’s to understand their rights and responsibilities of landlords

Free resources “Knowing your rights and responsibilities” course and a Toolkit for Tenants have been designed to educate and empower tenants to know their rights and responsibilities as well as provide useful assistance during a tenancy or when becoming a tenant for the first time.
